United States v. Henderson
What's at Stake
On behalf of the League of Women Voters of Utah, the ACLU Voting Rights Project and the ACLU of Utah have filed a motion to intervene in a lawsuit over the federal government’s demand for Utah’s voter registration file. The Department of Justice is demanding the entire state list, including voters’ sensitive personal data, such as drivers’ license numbers and partial Social Security numbers.
Summary
In August 2025, the federal Department of Justice (DOJ) sent a letter to Utah Lieutenant Governor Deidre Henderson, demanding the state’s complete and unredacted voter file. Utah officials declined to do so, citing privacy concerns. In February 2026, the DOJ responded by filing a lawsuit, one of at least thirty nearly-identical suits seeking statewide voter files.
The lawsuit appears to be part of federal efforts to create a national voter database, to engage in mass challenges of voter registrations. These voter purges could mistakenly result in eligible voters being removed from the rolls, and pose particular risks to certain groups, such as naturalized citizens.
The League of Women Voters of Utah—a nonprofit, nonpartisan, grassroots group dedicated to ensuring access to the ballot—filed a motion to intervene, to advocate for the rights of its members and all Utah voters. The League is represented by the ACLU Voting Rights Project and the ACLU of Utah.
